| (1) |
The Minister of relevant Member of the Executive Council must
comply with the procedures set out in this subsection when intending to issue or amend
regulations in terms of sections
(section numbers would be given here) |

(a) |
The intention to issue the regulation must be announced by
the notice in the Gazette and other appropriate means of communication. |
|
(b) |
The notice must specify that a public hearing on the proposed
content of the regulation will be made either |
|
|
(i) |
before publishing draft regulations; or |
|
|
(ii) |
after publishing draft regulations. |
|
(c) |
If a public hearing is to be held before publishing a
draft regulation |
|
|
(i) |
the notice must specify the date, time, place and procedure for
participating in the public hearing; |
|
|
(ii) |
After the hearing, daft proposed regulations must be published for
comment; |
|
|
(iii) |
The period for comment must be at least 30 days; |
|
|
(iv) |
At any time before issuing the regulations, further discussions or
consultations in any form may be held with any relevant interest group; and |
|
|
(v) |
The comments received must be considered before issuing regulations. |
|
(d) |
If a public hearing is to be held after publishing a
draft regulation |
|
|
(i) |
the notice must specify where a copy of the draft regulation may be
obtained and the date, time, place and procedure for participating in the public hearing; |
|
|
(ii) |
the date of the public hearing must be no less than 30 days after the
notice is published; |
|
|
(iii) |
at any time before issuing the regulation, further discussions or
consultations in any form may be held with any relevant interest group; and |
|
|
(iv) |
the comments received at the public hearing must be considered before
issuing the regulation. |

The Minister or relevant Member of the Executive Council must
comply with the procedures set out in this subsection when intending to issue or amend
regulations in terms of sections
